Terms of Service

These Terms of Service (“Terms”) govern your use of ZENNA, Nex, and any related websites, applications, and services (collectively, the “Service”) operated by Anthony West Inc (“ZENNA”, “we”, “our”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

ZENNA is a software service that provides a persistent intelligence assistant called Nex. The Service may include voice, text, and connected-application features that you choose to enable.

ZENNA evolves over time. We may add, change, or remove features. We will give reasonable notice of material changes that meaningfully reduce existing functionality.

You must be at least 13 years old (or the minimum age required in your country) to use the Service. You are responsible for the security of your account credentials and for any activity that occurs under your account. Tell us right away if you suspect unauthorized access.

You agree not to use the Service to:

• break the law or harm others;
• generate or distribute content that is unlawful, harassing, defamatory, or infringes someone else's rights;
• attempt to circumvent security, rate limits, or access controls;
• probe, scan, or reverse-engineer the Service except as expressly permitted by law;
• use the Service to build a competing product or to scrape data for training another model without our written permission;
• upload malware or attempt to disrupt the Service for other users.

We may suspend or terminate your access for violations of these Terms.

You keep ownership of the content you submit to the Service (“Your Content”). You grant us a limited license to host, store, process, and transmit Your Content as needed to operate the Service for you. We do not claim ownership of Your Content, and we do not use it for advertising.

You are responsible for Your Content and for ensuring you have the rights to share it with the Service.

Nex generates responses using AI models. AI output can be incomplete, inaccurate, or out of date. Do not rely on the Service for legal, medical, financial, or other professional advice, and do not use it as the sole basis for decisions that have meaningful real-world consequences. Always exercise your own judgment and, for consequential decisions, consult a qualified professional.

You are responsible for reviewing AI output before relying on it or sharing it with others.

You may connect third-party services (such as Google) to the Service. When you do, you authorize us to access and use the data those services return, under the scopes you approve, only to provide the features you have requested. See our Privacy Policy for more.

Third-party services have their own terms. We are not responsible for the acts or omissions of third-party services.

Some features may be labeled beta, preview, or experimental. They are provided as-is and may change or be removed at any time without notice.

We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, error-free, or always meet your expectations. We may perform maintenance and may modify or discontinue features.

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as required by applicable law.

To the maximum extent permitted by law, ZENNA and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to these Terms or the Service is limited to the greater of (a) the amounts you paid us for the Service in the twelve months before the claim, and (b) one hundred U.S. dollars (US$100).

You agree to defend and hold ZENNA harmless from claims arising from your violation of these Terms, your misuse of the Service, or your infringement of someone else's rights.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we are required to by law. Sections that by their nature should survive termination (for example, ownership, disclaimers, limitations of liability) will survive.

We may update these Terms from time to time. When we do, we will update the effective date above. If the changes are material, we will give you reasonable notice. Continued use of the Service after the effective date means you accept the updated Terms.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

By providing your mobile phone number and opting in within the ZENNA Nex companion app, you expressly consent to receive recurring automated SMS and MMS messages from Anthony West Inc, including account notifications, verification codes, and service alerts.
